• “Products”: Refers to electric karts and related items sold through the Site.
• “You” or “User”: Refers to anyone accessing or using the Site.

2. Acceptance of Terms

By using the Site or purchasing Products, you:

• Acknowledge that you have read and understood these Terms and agree to be bound by them.
• Represent that you have the legal capacity to enter into a binding agreement.

3. Eligibility to Use the Site

Users must be at least 18 years old to access the Site and make purchases. By using the Site, you represent that you meet this requirement. If you are under 18, you may only use the Site with the involvement and consent of a parent or legal guardian who agrees to be bound by these Terms.

4. International Users

• The Site is operated from the United States and complies with U.S. laws and regulations.
• If you access the Site from outside the United States, you are responsible for compliance with local laws.
• Import duties, taxes, or customs fees for international shipments are your responsibility.

6. Taxes

• All prices displayed on the Site are inclusive of applicable taxes for orders placed in the United States unless otherwise stated.
• Depending on your location, sales tax, value-added tax (VAT), or other applicable taxes may be added to your order total at checkout.
• Taxes are calculated based on the shipping address provided at checkout and in compliance with local laws and regulations.
• For international shipments, you are responsible for any import duties, customs fees, or taxes imposed by your country.

7. Shipping and Delivery

• All LIL ZMRS products are manufactured in the United States of America to high-quality standards and shipped worldwide.
• Estimated delivery times may vary depending on your location.
• We are not liable for delays caused by customs clearance, shipping providers, or circumstances beyond our control.
• Customers are responsible for all import duties, customs fees, and taxes.
• Shipping and tracking information will be provided once your order has been dispatched.

8. No Refunds / Returns Policy

Orders may be cancelled for a full refund within 14 days of the order or reservation date. Once production has begun, all sales are final — no cancellations, refunds, or returns will be accepted. Due to the custom-built nature of our Products, we are unable to make exceptions to this policy.

9. Product Descriptions

We strive to provide accurate descriptions of our Products. However:

• We do not warrant that descriptions, images, or specifications are error-free.
• Variations in color, finish, or specifications may occur due to customization or screen settings.

10. Intended Use & Safety Disclaimer

• LIL ZMRS electric karts are not street-legal and are intended for private property, track, or recreational use only.
• These Products are intended for use by operators 18 years of age or older. If purchased for a minor, the parent or legal guardian accepts full responsibility for ensuring the Product is operated safely and in accordance with these Terms.
• Users must operate the karts responsibly and in accordance with local laws.
• Appropriate safety gear must be worn at all times, including but not limited to a helmet, racing suit, armored suit, and racing gloves.

11. Order and Payment Information

• Orders are considered final once payment has been processed.
• Accepted payment methods include major credit cards and any other options displayed at checkout.
• All prices on the Site are listed in U.S. Dollars (USD) unless otherwise stated.
• Pricing and availability are subject to change without notice.

12. Assumption of Risk & Release of Liability

By purchasing a Product, you expressly assume all risks of injury, property damage, or other losses arising from the use, misuse, or modification of the Products. LIL ZMRS is not liable for any accidents, injuries, or damages resulting from the operation, modification, or misuse of the Products. You are solely responsible for the safe operation of the Products at all times.

13. Indemnification

You agree to indemnify and hold harmless LIL ZMRS, its owners, employees, and affiliates from any claims, damages, or expenses arising from:

• Your misuse of the Site or Products.
• Your breach of these Terms.
• Your violation of any law or third-party rights.

14. Disclaimer of Warranties

All Products, services, and content are provided “AS IS” without any warranty of any kind. LIL ZMRS expressly disclaims all warranties of merchantability, fitness for a particular purpose, quiet enjoyment, and non-infringement. We make no guarantee that the Products will meet your requirements or expectations.

15. Limitation of Liability

• LIL ZMRS’ liability is limited to the total amount paid for Products in the past 12 months.
• We are not liable for incidental, consequential, or punitive damages, even if advised of such possibilities.
• Some jurisdictions may not allow certain limitations, so these may not apply to you.

16. General Terms

• These Terms constitute the entire agreement between you and LIL ZMRS regarding the Site and Products.
• If any provision is found to be unenforceable, the remaining terms remain in effect.
• Failure to enforce any right under these Terms does not constitute a waiver.

17. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Colorado, USA. Except as provided in Section 18 (Dispute Resolution & Arbitration), any disputes not resolved through arbitration are subject to the exclusive jurisdiction of the courts in Colorado.

18. Dispute Resolution & Arbitration

Informal Resolution First. Before filing any formal legal claim, you agree to contact LIL ZMRS at hello@lilzoomers.com and give us 30 days to try to resolve the dispute informally. Both parties will make a good-faith effort to resolve the issue directly. Most concerns can be resolved this way.

Binding Arbitration. If we cannot resolve the dispute informally within 30 days, both parties agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or the Products — including questions about the validity, enforceability, or scope of this arbitration clause — will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be conducted in Colorado, or by telephone or written submission if both parties agree.

Arbitration is Final. The arbitrator’s decision will be final and binding, and judgment on the award may be entered in any court of competent jurisdiction. You understand that by agreeing to arbitration, you are waiving your right to a jury trial.

No Class Actions. All disputes must be brought in your individual capacity only. You may not bring a claim as a plaintiff or class member in any class action, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person’s claims.

Exceptions. Either party may seek emergency injunctive or other equitable relief in a court of competent jurisdiction in Colorado to prevent irreparable harm while arbitration is pending. Nothing in this section limits either party’s right to pursue small claims court for eligible disputes.
